WILCOX J: The appli­cants, Exec­u­tive Coun­cil of Aus­tralian Jew­ry and Jere­my Jones, chal­lenge a deci­sion of the sec­ond respon­dent, the Human Rights and Equal Oppor­tu­ni­ty Com­mis­sion (“HREOC”), to dis­miss a com­plaint under the Racial Dis­crim­i­na­tion Act 1975 against Olga Scul­ly , the first respon­dent. The Com­mis­sion, con­sti­tut­ed for the pur­pose by Com­mis­sion­er Robert Net­tle­fold, held both appli­cants lacked stand­ing to pur­sue the com­plaint.
