WILCOX J: The applic­ants, Executive Council of Aus­trali­an Jewry and Jeremy Jones, challenge a decision of the second respond­ent, the Human Rights and Equal Oppor­tun­ity Com­mis­sion (“HREOC”), to dismiss a complaint under the Racial Dis­crim­in­a­tion Act 1975 against Olga Scully , the first respond­ent. The Com­mis­sion, con­sti­tuted for the purpose by Com­mis­sion­er Robert Net­tle­fold, held both applic­ants lacked standing to pursue the complaint.
